Registration of Trademarks

Registration grants the trademark owner the exclusive right to prohibit others from using the same or a confusingly similar trademark on the same or similar goods and services. The principle of territoriality is essential in the registration of trademarks. This principle means that the trademark for which registration is requested is protected only in the country of registration.

 

The Turkish Patent and Trademark Office is the institution to apply for the registration of trademarks in Turkey. (www.turkpatent.gov.tr) This institution, abbreviated as TURKPATENT, provides trademark protection within Turkey. So, if people want to benefit from legal protection of their trademarks outside of Turkey, how should they proceed?

 

First of all, they can apply to the institutions dealing with trademark registration in other countries. For example, IPO in the United Kingdom, USPTO in the United States, INPI in France, DPMA in Germany and JPO in Japan.

 

In global business life, individuals and organizations register their trademarks in countries and regions where they can make sales. In fact, it is not possible for individuals to apply for trademark registration in all countries due to the application fees and the intensity of the registration application processes. For this reason, the Madrid System was established to ensure the international registration of trademarks in more than one country through a single application. With this system, the negative consequences of the principle of territoriality in trademark law are tried to be eliminated.
