Below is a general overview of the Administrative Review and Appeal processes : 

Administrative Review:

    • After receiving a refusal decision on your visa application, you may have the option to apply for an Administrative Review.
    • Administrative Review is a process where the decision is reviewed by a different immigration officer.
    • It is not an opportunity to submit new evidence but to challenge errors or misunderstandings in the initial decision.
    • How to Apply for Administrative Review:
    • The refusal letter you receive should contain information on how to apply for Administrative Review.
    • You typically need to complete a form and pay a fee for the Administrative Review process.
    • Timeframe:
    • There is usually a specific timeframe within which you must apply for Administrative Review (within 28 days of receiving the decision).
    • Outcome of Administrative Review:
    • After the review, the decision may be maintained, overturned, or the case may be sent back for further consideration.
    • Appeal Process:
    • If the Administrative Review is unsuccessful, you may have the option to appeal the decision.
    • The right to appeal depends on the type of visa application and the specific circumstances.
    • Appeal Rights and Tribunals:
    • Appeals are typically heard by an independent tribunal.

Administrative Review was generally available for the following types of visa applications:

Points-Based System (PBS) Visas:

    • Tier 1 (General), Tier 1 (Entrepreneur), Tier 1 (Investor), Tier 1 (Exceptional Talent)
    • Tier 2 (General), Tier 2 (Intra-Company Transfer), Tier 2 (Sportsperson), Tier 2 (Minister of Religion)
    • Tier 4 (General) Student Visas
    • Family and Partner Visas:
    • Spouse, civil partner, unmarried partner, and dependent child applications 
    • Other Visa Categories:
    • Other visa categories such as Ancestry Visas, Representative of an Overseas Business, etc.
